Terms and Conditions

  1. Fitness to Drive
    1. You must hold a current driving licence (UK provisional, UK full or international)
    2. You must be able to read a new style number plate at 20 meters or old style at 20.5 meters.
    3. Your Instructor reserves the right to cancel a lesson if it is suspected that you may be unfit to drive due to the effects of alcohol, drugs (prescribed or otherwise), or any other condition that may cause your driving to be unsafe or illegal. In such circumstances you will be required to pay for this lesson.
  2. Cancellations
    1. A minimum of 48 hours’ notice is required for a lesson cancellation.
      1. If a lesson is cancelled with less than 48 hours’ notice the full lesson price may become payable.
      2. The full lesson price must also be paid if you fail to attend a previously booked lesson.
      3. If a lesson is cancelled by your instructor, the instructor will rearrange a replacement lesson that suits both parties and may offer some compensation.
    2. In the event that your Driving Instructor is late due to unforeseen circumstances:
      1. Where possible the instructor will add the delayed time on to the end of the current lesson.
      2. If this is not possible then the delayed time will be added onto a future lesson, with your agreement.
  3. During Lessons
    1. The instructor will pick the Student up for their lesson at an agreed location and time. If the pupil doesn’t show at this location after 15 minutes the lesson will be cancelled and charged for unless the instructor has been prior informed of the delay.
    2. The use of mobile phones during lessons is prohibited and should be turned onto silent mode for the duration of the lesson to avoid unnecessary distractions. Your Driving Instructor also agrees not to use their phone whilst teaching, unless an urgent call is required or a call has been agreed at the beginning of the lesson. This also applies to the use of hands-free devices by both parties.
    3. Our instructors will only teach on a one-to-one basis unless the pupil has asked to have someone accompany them and the instructor is in agreement. In this instance the extra person must be seated in the back of the car and their presence must not be a detriment to the lesson.
  4. Special Offers
    1. Our introductory offer is available to all new customers that do not have a driving test appointment booked. If the driving test is booked full lesson prices will be charged.
    2. You receive a free lesson for each recommendation that gives your instructor a new customer. If the new customer chooses a different instructor a free lesson cannot be given.
    3. Special Offers may be amended or withdrawn at any time without notice.
  5. Gift Vouchers
    1. Gift vouchers are valid for 6 months from purchase date, or a date agreed at the time of purchase.
    2. A refund for gift vouchers can be given up to 28 days from date of purchase.
  6. Block Bookings
    1. Blocks up to 10 hours are valid for 6 months from date of purchase.
    2. Blocks over 10 hours are valid for 12 months from date of purchase.
    3. A refund must be claimed within 28 days from payment.
    4. Partial refunds are subject to a £10 admin fee, hours used charged at normal lesson rate, remaining monies will be refunded to the original payer.
  7. Driving Test
    1. Our driving instructors must be satisfied that you are close to driving test standards before they will allow their cars to be used for a driving test. If you have learnt to drive elsewhere we will insist on an assessment driving lesson and may recommend a course of driving lessons.
    2. On the day of your test a minimum of a one hour lesson is mandatory to ensure final preparations can be made for your test. In addition to this there is also a one hour charge for the use of your Instructor’s car for the test. If you desire a longer pre-test lesson, this can easily be arranged.
    3. In the event of an insurance claim being made due to an incident occurring during the driving test, you will be asked to pay the insurance excess charge.
    4. If your test is cancelled due to Examiner illness, you may be entitled to compensation from the DVSA. The full session will remain payable. Your test will be rearranged automatically by the DVSA.
    5. If your test is cancelled due to bad weather there is no compensation from the DVSA. The full session will remain payable. Your test will be rearranged automatically by the DVSA.
  8. Limitation of liability
    1. Your instructor and/or Learn Smart Driving School are not liable to you for any loss or damage caused where, and to the extent that:
      1. there is no breach of a legal duty owed to you by the relevant person or body;
      2. such loss or damage is not a reasonably foreseeable result of such a breach;
      3. any such loss or damage, or increase in the same, results from any breach or omission by you;
      4. any such loss or damage results from circumstances or matters outside of the reasonable control of the relevant person or body.
    2. Your instructor and/or Learn Smart Driving School shall not, in any event, be liable for losses relating to any business interests you may have including, without limitation, lost profits, lost earnings, loss of opportunity or business or business interruption.
    3. You are reminded that Learn Smart Driving School are not party to the contract for driving tuition itself, which is between you and your instructor. This does not affect any liability that Learn Smart Driving School may have for any loss or damage you may incur which is caused directly as a result of any breach (including negligence) by it or them of any legal duty owed by it or them to you.
    4. We cannot be held responsible for monetary transactions between you and the instructor.
  9. Instructor Conduct
    1. All our driving instructors teach to the latest guidelines as set out by the DVSA;
    2. All our driving instructors are CRB checked on a regular basis on behalf of the DVSA;
    3. All our driving instructors will provide a professional service to the highest standards;

      1. In booking a driving lesson with us, you agree to providing sufficient information that our driving instructor can contact you and knows where to meet you. 
      2. We will send a booking confirmation email containing all of the  information we have stored.

      1. In making an online paymemt, you agree to provide sufficient information to verify you are the card holder or have permission to make a payment.
    3. Information Security
      1. All information collected is held securely with our providers, all of whom are fully compliant with all data handling regulations.
